From declaration to registry authorisation
The preliminary process for a civil marriage starts before the wedding appointment. In Portugal, it begins when the couple declares its intention to marry to a civil registry (conservatória do registo civil). Where the law permits it, a representative holding a power of attorney with special powers may initiate the process.
The conservatória examines the application and checks whether legal impediments prevent the marriage. It then authorises or refuses the proposed marriage. Starting the application does not mean that the marriage has already been approved or registered.

How the registry checks foreign documents
For a foreign partner, the Portuguese registry requires identification, a birth certificate and, when the country of nationality issues one, a certificate of matrimonial capacity. It may ask for other documents necessary to assess the individual file. Foreign records can also raise questions about legalisation or translation.
